Broker Participation Policy
While customers are free to use their own broker or agent when purchasing a home from Trevi Hills Realty, Inc., Trevi Hills Realty, Inc. does not pay commissions to cooperating real estate brokerages in all communities; nor in all homes within a community.
In order for a participating cooperating real estate brokerage (“Cooperating Broker”) to receive a commission in connection with the sale of real property in a certain community, Trevi Hills Realty, Inc. must be offering a commission in that community, and the Cooperating Broker must be documented on the first customer interaction with a Trevi Hills Realty, Inc. sales associate.
This means that the prospective buyer (the “Prospect”) must identify and register the Cooperating Broker:
(i) when the Prospect first contacts a Trevi Hills Realty, Inc. representative about a home or community;
(ii) when the Prospect first discusses or is introduced to a community or home by Trevi Hills Realty, Inc.’s internet or sales staff;
(iii) when the Prospect first visits a community; or
(iv) when the Prospect first attends a self-guided or virtual tour of a community accompanied by the Cooperating Broker or its sales associate, whichever occurs first.
Failure of a Prospect to register a Cooperating Broker upon the initial communication with Trevi Hills Realty, Inc. about any community will render the Cooperating Broker ineligible for commission. Registration alone of a Prospect by a Cooperating Broker is not sufficient for eligibility. The Cooperating Broker, or its affiliated sales associate, must also accompany the Prospect during the Prospect’s initial visit or self-guided tour of a home in the community.
If the Prospect is not local and does not visit in person, the Cooperating Broker, or its affiliated sales associate, must accompany the Prospect on the first virtual tour. If Trevi Hills Realty, Inc.’s tracking system indicates that the Prospect previously inquired about a community without identifying and registering the Cooperating Broker, or previously attended a sales office or self-guided tour without such registration or accompaniment, neither the Cooperating Broker nor its associate shall be entitled to receive a commission in connection with the sale of any home to such Prospect.
Unless otherwise agreed to in writing, registration is effective for sixty (60) days from the date of registration (“Registration Period”). The Cooperating Broker may extend the Registration Period for an additional sixty (60) days by accompanying the Prospect to the community’s sales office in person (or virtually if the Prospect is not local) before expiration of the initial period.
Additional terms and conditions may apply by community. The Cooperating Broker will not be eligible for a commission if the Cooperating Broker and Trevi Hills Realty, Inc. do not execute a written agreement (“Cooperating Broker Agreement”) setting forth the commission amount and any additional terms prior to or at the time the Prospect executes a purchase agreement.
The Cooperating Broker Agreement shall be null and void if the Cooperating Broker or its sales associate has violated the terms of this Broker Participation Policy. To be eligible to receive a commission, the Prospect must contract to purchase a home before expiration of the Registration Period and close on the home purchase in accordance with the executed Purchase and Sale Agreement.
This registration, or any extension thereof, does not protect a Cooperating Broker from another broker registering the same Prospect with Trevi Hills Realty, Inc. In all cases, the Cooperating Broker shall be solely responsible for payment of any commission to its own sales agents.
All registration forms, sign-up sheets, incentives, contracts, or other materials provided to Prospects or buyers of homes are proprietary and constitute trade secrets of Trevi Hills Realty, Inc.
Offers, Incentives, and Referral Policy
All special offers, incentives, and seller contributions (“Offers”) from Trevi Hills Realty, Inc. are subject to specific terms, conditions, and restrictions, which may include the use of designated lenders, title companies, and/or escrow agents. Certain Offers may impact the buyer’s loan amount or qualification, and buyers are encouraged to consult their lender for details prior to entering into a purchase agreement.
Offers are valid for a limited time only and are subject to change or withdrawal by Trevi Hills Realty, Inc. at any time without notice. Offers are community- and home-specific, may vary by product or homesite, and may not be combined with any other Offer or promotion unless expressly stated in writing.
The stated value of Offers is approximate and may vary based on home selection, closing date, and financing structure. All Offers are void where prohibited by law and where prior registration or qualification is required. Trevi Hills Realty, Inc. reserves the right to modify or terminate any Offer at any time.
Referral Program:
Trevi Hills Realty, Inc. may, from time to time, offer referral incentives to existing homeowners or prospective buyers who refer friends or family members to a Trevi Hills community. Referral incentives are promotional in nature and not contingent upon a sale closing.
Referral participants must not engage in any activity requiring a California real estate license, such as soliciting, negotiating, or representing another party in a transaction. Referral incentives, if offered, are typically provided in the form of a gift card, closing credit, or other nominal thank-you item, consistent with California law and the Real Estate Settlement Procedures Act (RESPA).
Licensed real estate brokers and agents remain eligible for separate Broker Referral Commissions only as provided under the Trevi Hills Realty, Inc. Broker Participation Policy and with a fully executed written Broker Agreement.
